Alleged Victim Declines to Move Forward with Case
The news of the case being dropped was revealed on the Miami-Dade County Court website.
Davis was arrested on July 11 on a misdemeanour battery charge in Miami Beach, Florida. This arrest came almost one month after he allegedly assaulted his ex-partner. TMZ first reported the news of the case being dropped.
The Miami-Dade State Attorney’s Office said in a statement to TMZ: “This case was dropped as the victim is declining to prosecute per her victim attorney, Lindsey Chase, Esq. and her sentiments we directly confirmed by the Assistant State Attorney handling the prosecution.”
“The witness to the incident, who is the victim’s mother, also failed to cooperate and failed, after being subpoenaed for a prefile conference on (Aug. 7). Followed up attempts to contact the (mother) via phone were unsuccessful.
“The incident itself was not observed by the police officer who had been called to the scene eliminating him as a possible witness to what had transpired.”
Gervonta Davis: Alleged Incident
The alleged incident in June was said to have occurred when Davis went to collect his children on Father’s Day. An argument is said to have ensued, which escalated to the physical stage, according to the police report at the time. Davis then told his ex-girlfriend to remove their children from his car as he did not want to take them. She was then allegedly struck in the back of the head and slapped, causing a minor cut to the inner part of her lip, as per the police report.
Davis’ ex-partner then texted her mother to come outside, who came out and witnessed an emotional argument, and recorded Davis throwing a small box at her daughter.
Legal Troubles Cast Doubt on Gervonta Davis Return
Despite entertaining inside the ring, Davis has had several legal issues, including accusations of domestic violence and the vehicular hit and run, for which he is on probation and has served time. The reigning WBA lightweight champion was last seen in the ring when he was involved in a highly controversial majority draw against Lamont Roach. Plans for a rematch against Roach have been rumoured, but look no closer to being confirmed.
Will we ever see Davis back in the ring? Boxing will be a better place with an active, focused Gervonta Davis in it.
